How to Calculate Annual Leave (UK Law)

Under the Working Time Regulations 1998, all workers in the UK are entitled to a minimum of 5.6 weeks of paid holiday per year. For someone working a standard five-day week, this equals 28 days (5 × 5.6 = 28).

The UK Annual Leave Formula

Days worked per week × 5.6 = Annual leave entitlement

Key Points About UK Statutory Leave:

  • Maximum cap: The statutory entitlement is capped at 28 days, even if you work 6 or 7 days per week
  • Bank holidays: Employers can include the 8 bank holidays within the 28-day minimum - there's no separate legal right to bank holidays off
  • Day one rights: Leave begins to accrue from your first day of employment with no qualifying period
  • All workers covered: Full-time, part-time, agency, and zero-hours workers all have the same 5.6 weeks entitlement

Part-Time Holiday Calculator

Part-time workers have exactly the same right to 5.6 weeks paid leave as full-time workers. The entitlement is simply calculated on a pro-rata basis using the same formula.

Example: 3 Days Per Week

Sarah works Monday, Wednesday, and Friday.

25 days × 3/5 = 15 days

Rounded to nearest half-day as per UK practice.

Example: 4 Days Per Week

John works Monday to Thursday.

25 days × 4/5 = 20 days

Or calculate in hours for more precision.

Part-Time Workers Regulation 2000

Under the Part-Time Workers Regulations, employers must not treat part-time workers less favourably. If full-time staff get bank holidays on top of 28 days, part-timers must receive a proportional equivalent.

Zero-Hours Contract Holiday Calculator

For workers with irregular hours (zero-hours contracts, casual staff, bank workers), calculating leave in days is impractical. Instead, use the 12.07% accrual method.

The 12.07% Rule

For every hour worked, the employee accrues 12.07% of that hour as paid leave.

This percentage comes from: 5.6 weeks ÷ 46.4 working weeks (52 - 5.6) = 12.07%

Example: Zero-Hours Worker

Maria works varying shifts and has worked 200 hours this quarter.

200 hours × 12.07% = 24.14 hours holiday accrued

Maria has earned approximately 24 hours of paid leave to take.

This method ensures zero-hours workers receive their full statutory entitlement regardless of how irregular their schedule. Use the calculator above in "Zero-Hours" mode to calculate your accrued leave instantly.

Pro-Rata Leave for Mid-Year Starters

When an employee starts partway through the leave year, their entitlement is calculated on a pro-rata basis for the remainder of that year.

Pro-Rata Formula

(Remaining days ÷ 365) × Full entitlement = Pro-rata entitlement

Example: Starting 1 July 2026

James is full-time (25 days entitlement). His company's leave year runs Jan-Dec. Starting 1 July means 184 days remaining.

Remaining days in year:184 of 365
Pro-rata calculation:(184 ÷ 365) × 25
Holiday entitlement:12.5 days (rounded to nearest 0.5)

Use the calculator above with your start date to get an instant pro-rata calculation. The same formula applies when employees leave mid-year - they're entitled to payment for any accrued but untaken leave.
