Is overtime pay compulsory in the UK?
No. UK law does not require employers to pay a premium rate for overtime. There is no statutory right to time-and-a-half or double time. Overtime pay is governed by what is stated in the employment contract. However, the total pay divided by total hours worked must never fall below the National Minimum Wage (£12.21/hour for workers aged 21+ in 2026).
How do you calculate time and a half in the UK?
Multiply the employee's standard hourly rate by 1.5. For example, if an employee earns £15/hour, their time-and-a-half rate is £15 × 1.5 = £22.50/hour. For overtime hours, multiply the number of overtime hours by this rate to get the overtime pay.
What is double time pay?
Double time means the employee is paid twice their normal hourly rate for overtime hours. If an employee earns £15/hour normally, double time is £30/hour. Double time is typically reserved for bank holidays, Sundays, or extended overtime in sectors such as construction and healthcare.
How is overtime calculated for salaried employees?
Convert the annual salary to an hourly rate first: divide the annual salary by 52 (weeks), then divide by contracted weekly hours. For example, a £30,000 salary with 37.5 contracted hours gives £30,000 ÷ 52 ÷ 37.5 = £15.38/hour. Then apply the overtime multiplier to this rate.
Does overtime count towards holiday pay?
Yes — for workers who regularly work overtime. Following the Bear Scotland and Flowers cases, regular voluntary overtime must be included when calculating holiday pay for the first 4 weeks of statutory leave. Guaranteed and non-guaranteed overtime must also be included.
What is the maximum overtime an employee can work in the UK?
Under the Working Time Regulations 1998, workers cannot work more than an average of 48 hours per week (including overtime) over a 17-week reference period, unless they have signed a written opt-out agreement. Workers can withdraw their opt-out at any time by giving the notice period specified in the agreement (up to 3 months).
Can my employer make me work overtime?
Only if your employment contract includes a compulsory overtime clause. Your employer cannot force you to work overtime that is not in your contract. If overtime is voluntary, you have the right to refuse. Check your contract — it should state whether overtime is compulsory, the rate at which it is paid, and how much notice you will be given.
What is TOIL (Time Off In Lieu)?
TOIL is when an employer offers paid time off instead of overtime pay. For example, if you work 2 extra hours on a Saturday, you might receive 2 hours of paid time off to take later. TOIL is not a legal requirement — it is only available if your employment contract allows it. The rate at which TOIL accrues (e.g. 1:1 or 1.5:1) should be specified in your contract.
How do I calculate overtime for irregular hours workers?
For irregular hours workers, first calculate the hourly rate for the hours actually worked. If the contract specifies an overtime threshold (e.g. anything over 8 hours per day or 40 hours per week), count the hours above that threshold as overtime and apply the agreed multiplier. For zero-hours workers, overtime typically only applies if the contract specifies a minimum hours threshold.
Does overtime affect National Minimum Wage compliance?
Yes. Even if overtime is unpaid or paid at a reduced rate, the total pay divided by total hours (including overtime hours) must never fall below the National Minimum Wage. For workers aged 21+, the NMW is £12.21/hour in 2026. If overtime brings the effective hourly rate below this, the employer is breaking the law and HMRC can impose back pay and penalties.
