What Is a TOIL Policy and Why Do You Need One?
TOIL (Time Off In Lieu) is time off granted to employees who work overtime, instead of — or in addition to — additional pay. Unlike annual leave, TOIL has no statutory framework in the UK. That means you must define the rules yourself — otherwise you'll have endless disputes about how much TOIL has been accrued, when it can be taken, and when it expires.
A clear TOIL policy protects both the employer and employee. It sets the accrual rate, expiry window, approval process, and what happens to unused TOIL when someone leaves. Without one, you're managing TOIL on good faith and memory — which rarely ends well.
For the full legal context and employer obligations, read our TOIL UK guide and our comparison of TOIL vs overtime pay.
What Should a TOIL Policy Include?
- Eligibility: Which employees are eligible for TOIL (not all roles may qualify)
- When overtime qualifies: The threshold at which overtime earns TOIL
- Accrual rate: How many TOIL hours are earned per overtime hour (1:1, 1.25:1, 1.5:1, etc.)
- Authorisation: How overtime must be authorised before it qualifies for TOIL
- Maximum balance: Whether there is a cap on accrued TOIL
- Expiry: When TOIL must be taken by (e.g., within 3 months)
- How to request TOIL: The booking and approval process
- Interaction with holiday pay: How TOIL affects annual leave calculations
- On termination: Whether unused TOIL is paid out

How to Use This Template
Replace all text in square brackets with your business-specific details:
- Choose one of the OPTION A / B / C alternatives in each section and delete the others
- Set your accrual rate — 1:1 is most common; enhanced rates (1.25× or 1.5×) are more employee-friendly and improve retention in shift-based environments
- Set the expiry window — 3 months is common in retail and hospitality; 6 months works well for professional services
- Decide on the termination treatment — paying out unused TOIL is cleaner; requiring it to be taken in the notice period is more common for senior roles
- If you use TimeTally, replace [time tracking system] references with "TimeTally"

Tracking TOIL Without a Spreadsheet
Manual TOIL tracking — even with a good policy — is error-prone. Balances drift out of sync, expiry windows are missed, and employees end up in disputes about hours they worked months ago. TimeTally automates the entire process: overtime is captured on the timesheet, the TOIL accrual rate is applied automatically, and employees can see their balance and book time off — all without any manual input from HR.
